SMOKES MART AFFILIATE TERMS AND CONDITIONS

1. Introduction

These Affiliate Terms and Conditions (“Agreement”) govern your participation in the Smokes Mart Affiliate Program (“Program”). By enrolling, you agree to comply with these terms and all applicable laws and regulations.

2. Enrollment in the Program

To join, you must complete and submit the affiliate application form on our website. Smokes Mart reserves the right to approve or reject any application at its sole discretion.

3. Affiliate Responsibilities

  • You agree to promote Smokes Mart products honestly, ethically, and in compliance with all applicable advertising and data-protection laws.

  • You may use our promotional materials as provided, but you may not alter or misrepresent them.

  • You must not engage in any misleading, spam, or deceptive marketing practices.

  • You are solely responsible for your marketing channels and content.

4. Affiliate Links and Tracking

Once approved, you will receive a unique affiliate link or tracking code. It’s your responsibility to ensure that your referrals use your link correctly so that commissions can be properly tracked.

5. Commissions and Payments

  • Commissions are earned on qualifying purchases made through your affiliate link.

  • The current commission rate and payment schedule are listed in your affiliate dashboard.

  • Payments are made via PayPal (or another approved method) once your balance meets the minimum payout threshold.

  • Commissions may be reversed in cases of refunds, chargebacks, or fraudulent transactions.

6. Termination

Either party may terminate this Agreement at any time, with or without cause, by providing written notice. Upon termination, you must immediately remove all affiliate links and Smokes Mart promotional materials from your website, social media, or other channels.

7. Intellectual Property

All logos, images, and promotional materials provided by Smokes Mart remain our property. Affiliates are granted a limited, non-exclusive, non-transferable license to use these materials solely for the purpose of promoting Smokes Mart products.

8. Limitation of Liability

Smokes Mart will not be liable for indirect, incidental, or consequential damages arising from participation in the Program. Our total liability shall not exceed the total commissions paid to you.

9. Modification

Smokes Mart reserves the right to modify or update these terms at any time. Continued participation after any changes are posted will constitute your acceptance of the revised terms.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to conflict of law principles.
